Terms of Service
These terms govern your use of Cracking Flags. They are written to be clear and direct. If something is ambiguous, ask us before relying on it.
What Cracking Flags provides
Cracking Flags is a heat stress monitoring platform. It retrieves weather data from professional sources, applies your organisation's heat stress policy thresholds, and returns a calculated heat stress level with corresponding recommendations.
The platform is a decision-support tool. It is designed to help trained personnel act on heat stress conditions more consistently and efficiently. It does not replace the judgement of a qualified safety officer, and it should not be the sole basis for health and safety decisions in your organisation.
Trials
We offer a 14-day free trial on request. Trials are provided at our discretion and may be declined or ended early if we determine the platform is not a suitable fit. At the end of a trial, access is suspended unless you have agreed to a paid plan.
Trial data (saved locations, threshold configurations) is retained for 30 days after trial expiry. After that it is deleted permanently.
Subscriptions and payment
Paid plans are billed annually in Australian dollars. Pricing is agreed during onboarding and confirmed in writing before any charge is made. We do not charge your payment method without explicit authorisation.
You may cancel your subscription at any time by contacting us at scott@crackingflags.com. Cancellations take effect at the end of the current billing period. We do not offer partial refunds for unused time.
Acceptable use
You agree to use Cracking Flags only for lawful purposes and in ways consistent with its intended function as a safety tool. You must not attempt to reverse-engineer, scrape, overload, or otherwise interfere with the platform.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Weather data accuracy
We source weather data from professional third-party providers with high update frequencies. However, weather data is inherently imprecise, particularly at hyper-local scales. Cracking Flags makes no warranty that the conditions shown reflect the exact conditions at your specific location at any given moment.
For safety-critical applications, we recommend supplementing platform readings with on-site observation, particularly in rapidly changing conditions. If you require higher precision, our Enterprise plan supports on-site sensor integration.
Limitation of liability
To the fullest extent permitted by Australian law, Cracking Flags and its operators are not liable for any direct, indirect, incidental, or consequential loss or damage arising from your use of the platform, including any health or safety incident that occurs despite or in connection with platform use.
Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Availability
We aim to keep the platform available at all times but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for loss or inconvenience caused by downtime.
During the trial and early access period, the platform is provided as-is without any uptime commitment. Service level agreements are available on Enterprise plans.
Your data
You retain ownership of the data you upload or generate in the platform (saved locations, custom thresholds, audit logs). We process this data to provide the service and do not use it for any other purpose. See our Privacy Policy for full details.
On cancellation or account closure, you may request an export of your audit logs before deletion. We will provide this in CSV format within five business days of request.
Changes to these terms
We may update these terms as the platform and our business evolve. If we make material changes, we will notify active customers by email at least 14 days before the changes take effect. Continued use of the platform after that date constitutes acceptance of the updated terms.
Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
